5. Copyright Compliance (DMCA)

If you believe that any material on the Site infringes upon any copyright which you own or control, you may send a written notification of such infringement to our designated agent. Eskuad respects the intellectual property rights of others and will respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act.

6. Disclaimer of Warranties

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESKUAD'S AGGREGATE LIABILITY ARISING OUT OF YOUR USE OF THE SITE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO ESKUAD IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. ESKUAD SHALL NOT BE LIABLE FOR CONSEQUENTIAL DAMAGES.

8. Termination

Eskuad reserves the right, without notice and in its sole discretion, to terminate your license to use the Site and to block or prevent your future access to and use of the Site if you violate these Terms or our Acceptable Use Policy.

9. Dispute Resolution; Arbitration

9.1 Binding Arbitration. Any dispute arising out of these Terms shall be settled by binding arbitration under the rules of the American Arbitration Association (AAA).

9.2 Class Action Waiver. ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida. Jurisdiction for any non-arbitrable legal action shall be exclusively in the courts located in Hillsborough County, Florida.
